Terms of Service

1. Who we are

The Platform Corralejo Living (the "Platform", "we", "us", "our") is operated and published at corralejoliving.com by GOYEN ETCHE CONNECT SL, a Spanish limited liability company (Sociedad Limitada) incorporated on 28/07/2025, NIF B22809719, registered office at Calle Lepanto 270, 08013 Barcelona, Spain. Contact: hola@corralejoliving.com. These identification details are published in accordance with article 10 of Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE).

The Platform connects independent users — including locals, residents, digital nomads, hosts, freelancers, surf coaches, small businesses, independent providers and travellers — for the purpose of discovery, community, lifestyle content and the booking of stays, rentals, services, experiences and local deals.

Corralejo Living is strictly a technology intermediary and a hosting provider of user-generated content within the meaning of Directive 2000/31/EC, Spanish Law 34/2002 (LSSI-CE) and Regulation (EU) 2022/2065 (Digital Services Act). We do not own, operate, manage, supervise, employ, license, insure or guarantee any host, provider, listing, business, activity, lesson, accommodation, deal or transaction published or arranged through the Platform.

2. Acceptance of these Terms

By creating an account, signing in, browsing, sending a booking request, contacting a host, claiming a listing or otherwise using the Platform, you confirm that you have read, understood and accepted these Terms of Service, the Privacy Policy, the cancellation and refund terms, the community guidelines and any product-specific terms displayed in the user interface.

If you do not agree with any part of these Terms, you must stop using the Platform immediately. We may ask you to re-accept these Terms whenever they are updated materially.

3. Eligibility

You may use the Platform only if you are at least 18 years old, have full legal capacity to enter into binding contracts, and are not barred from using the Platform under the laws of your country, the country where the activity takes place, or by a previous suspension. Hosts and providers further represent that they are legally entitled to offer their listing — including holding any required licence, registration, tax number, insurance or local authorisation.

4. Nature of the service — intermediary only

Corralejo Living provides software, listings, search, messaging, scheduling, optional payment facilitation and discovery tools. We are not a travel agency, tour operator, real-estate agency, surf school, sports operator, employer, transport provider, financial institution, insurer, escrow agent, or party to any contract between users.

Every contract for a stay, rental, lesson, service, experience or local deal is concluded directly between the host/provider and the guest/customer. The Platform is not a party to that contract, owes no obligations under it, and bears no liability for its performance or non-performance.

5. User-generated content

Listings, photos, descriptions, prices, availability, reviews, messages, profile data and any other content visible on the Platform are submitted by users. We act as a passive hosting provider in the sense of EU Directive 2000/31/EC and the EU Digital Services Act (Regulation (EU) 2022/2065). We do not pre-screen, verify, endorse or guarantee any user content.

Users are solely responsible for the accuracy, legality, completeness and updates of the content they publish. We may remove or restrict any content at our sole discretion, with or without notice, where we believe it violates these Terms, the law, or community standards — including but not limited to fraudulent, deceptive, dangerous, discriminatory, sexual, violent, defamatory, infringing or unlawful content.

6. Hosts and providers — responsibilities and warranties

If you publish a listing, offer a service or take a booking through the Platform, you represent and warrant on a continuing basis that:

  • You are legally authorised to operate the activity, accommodation, lesson, service or business advertised — including holding any required licence, permit, registration, tourism number, professional qualification, insurance, health & safety authorisation and tax registration applicable in your jurisdiction.
  • Your listing complies with all applicable laws, including building, fire-safety, zoning, sub-letting, hospitality, environmental, consumer-protection, anti-discrimination, marine/sport safety, transport and tax laws.
  • You hold valid civil-liability and activity-specific insurance covering yourself, your premises, your equipment and your customers, including for sport, water, surf, transport and outdoor risks where relevant.
  • You will accurately describe what is offered, including risks, requirements, restrictions, cancellation conditions and price.
  • You will collect, declare and pay any applicable tourist tax, VAT/IGIC, income tax, social-security contribution and any other tax or charge due. The Platform does not act as your fiscal representative.
  • You will not use the Platform to launder funds, finance terrorism, evade tax, circumvent sanctions or commit any offence.

If any of these representations is or becomes false, you must remove your listing immediately. We may suspend or terminate your account without notice and report violations to the competent authorities.

7. Guests / customers — responsibilities

As a guest, customer or community member, you agree that:

  • You enter into the contract for the stay, lesson, service or experience directly with the host or provider, at your own risk and under your own responsibility.
  • You will read and respect the host's rules, requirements, safety briefings, cancellation policy and any local laws or customs.
  • You are responsible for assessing whether an activity is suitable for your physical and medical condition. You will not participate in surf, water, sport, fitness or outdoor activities if you are not fit or not sufficiently insured.
  • You will not consume alcohol, drugs or any substance before or during a sport or water activity, and you will follow all safety instructions.
  • You will not use the Platform to harass, stalk, defraud, scam, threaten, intimidate or solicit other users.
  • You will pay any tourist tax, security deposit or local fee due to the host or local authority.

8. Accommodations and rentals — specific clauses

Listings of stays, rentals, rooms, beds or co-living spaces are published under the host's sole responsibility. The Platform makes no representation as to legality, licensing, safety, hygiene, fire compliance, sub-letting rights, tax declaration or insurance of any accommodation. Guests must satisfy themselves on these points before booking and on arrival.

The Platform is not liable for: undeclared activity, illegal short-term-letting, missing tourism registration, unpaid taxes, eviction, lock-outs, double-bookings, last-minute cancellations, theft, damage, accident, fire, water damage, pest infestation, neighbour disputes, noise, missing amenities, bedbugs, allergens, injury or death occurring on the premises.

9. Experiences, surf, water sports and outdoor activities — high-risk disclaimer

Surf, kitesurf, windsurf, paddle, diving, freediving, snorkelling, sailing, boat tours, climbing, hiking, yoga, fitness, transport, off-road, e-bike, scooter and any outdoor or sport activity advertised on the Platform involve inherent and serious risks — including drowning, injury, paralysis and death.

By booking such an activity you irrevocably acknowledge and accept that:

  • You take part voluntarily and at your own risk;
  • The Platform is not the organiser, instructor, supervisor, transport provider or insurer of the activity;
  • The Platform does not verify the qualifications, licensing, insurance, equipment, safety procedures, weather assessment or first-aid capabilities of the provider;
  • You are solely responsible for ensuring that you hold adequate personal accident, repatriation and civil-liability insurance;
  • You will follow the safety instructions of the provider and will not engage in dangerous behaviour;
  • You release the Platform from any and all claims arising from injury, accident, damage or death sustained during or in connection with the activity, to the maximum extent allowed by applicable law.

10. Local businesses, freelancers and informal providers

The Platform allows independent local businesses, freelancers, surf coaches, yoga teachers, photographers, transport providers, cleaners, fixers and other independent operators to publish offers. Some providers may operate informally or without a formal business structure. It is the provider's sole responsibility to comply with applicable business, tax, labour, social-security, immigration and consumer-protection laws.

The Platform does not act as employer, principal, agent or guarantor of any provider and is not responsible for undeclared work, tax fraud, unregistered businesses, missing professional qualifications, false advertising, fake reviews, scams or any disputes between users and providers.

10b. Real-estate listings (properties for sale) — specific clauses

The Platform may display listings of properties for sale ("Real-Estate Listings") published by independent real-estate agencies, property managers, owners, developers or other professionals. Such listings are contact-only lead-generation listings — the Platform does not conclude, broker, mediate, negotiate or formalise any sale, reservation, deposit, purchase offer, mandate, mortgage, rental-to-own or any other real-estate transaction.

Corralejo Living is not a real-estate agency, not a real-estate intermediary ("agente de la propiedad inmobiliaria" / "API"), not an "intermediario inmobiliario" under Spanish Ley 2/2009, not an estate agent under the laws of the Canary Islands (Decreto 5/2018) or any other autonomous community, and not a financial intermediary. No part of these Terms shall be construed as creating an agency, brokerage, mandate, partnership, joint venture or fiduciary relationship between the Platform and any agency, owner, buyer or seller.

By publishing a Real-Estate Listing, the publisher represents and warrants that: (a) they are legally authorised under Spanish law (including RD 515/1989 on the protection of consumers in the sale of dwellings, Ley 2/2009, Ley 38/1999 (LOE), and any applicable autonomous-community register of real-estate intermediaries) to advertise and market the property; (b) all required information — price, surface area, energy certificate (CEE) reference, charges, IBI, community fees, encumbrances, urbanistic situation — is accurate, up to date and lawfully disclosed; (c) they hold a valid mandate from the owner where required; (d) photographs and descriptions are accurate and not misleading; (e) they comply with all applicable anti-money-laundering, KYC and beneficial-ownership obligations (Ley 10/2010); (f) they will handle any deposit, reservation fee or earnest money ("señal" / "arras") in a segregated client account and not via the Platform.

By contacting a publisher through a Real-Estate Listing, the user acknowledges and agrees that: (a) the Platform is not a party to any subsequent negotiation, visit, reservation, purchase offer or sale; (b) the Platform does not verify the legal status, ownership, building permits, occupancy permits ("cédula de habitabilidad"), tax compliance, mortgage situation, charges, urbanistic compliance, structural condition, asbestos, lead, energy class or habitability of any property; (c) the Platform makes no representation as to the value, marketability or investment merits of any property; (d) the user is solely responsible for engaging an independent lawyer ("abogado"), notary ("notario"), surveyor and tax advisor before signing any document, paying any deposit or transferring any funds; (e) any in-person visit is at the user's own risk.

Anti-scam warning: the user must never transfer money, pay a deposit, send a copy of their ID, sign a reservation contract or share banking details based solely on a Platform message. Any payment must be made through a regulated escrow account, a Spanish notary or a verified bank account belonging to a confirmed legal owner — never to a personal account, cash courier, crypto wallet or third-party intermediary not formally identified. The Platform is not liable for any fraud, identity theft, fake listing, fake agency, advance-fee scam, rental scam, deposit theft, double-sale, hidden encumbrance or any other loss connected with a Real-Estate Listing or its publisher.

11. Bookings, payments and refunds

The Platform may facilitate payments through third-party payment processors (such as Stripe). Where a host operates a Stripe account, payments are processed directly to the host's account; where direct payment methods are displayed (bank transfer, IBAN, PayPal, Wise, Revolut, Bizum, cash on arrival, etc.), the payment occurs directly between guest and host outside the Platform, and the Platform has no visibility, control or liability over those payments.

Service fees, host fees and any guest fee displayed are payable as shown at booking. The Platform reserves the right to charge a commission on facilitated payments. Refunds, cancellations and disputes are governed by the host's published policy and applicable consumer law; the Platform may assist but is not a party to the underlying contract and is not an escrow agent.

You must not: use stolen cards, fake IBANs or fake wallets; perform chargebacks for legitimate services received; attempt to launder funds; or contact a host off-Platform to circumvent service fees.

12. Anti-fraud and anti-circumvention

You agree not to bypass the Platform's booking, payment or messaging tools in order to avoid fees, reviews, traceability or consumer protection. The Platform may impose contractual damages equal to lost commission for repeated circumvention and may suspend or terminate accounts that engage in fraud, fake listings, fake reviews, identity theft, phishing, account take-over or coordinated abuse.

13. Reviews and reputation

Reviews must be honest, first-hand, lawful and free from personal attacks, discrimination or unverified accusations. The Platform may moderate, edit or remove reviews that violate these standards. Hosts and guests may not buy, exchange or coerce reviews.

14. Messaging and community conduct

The Platform offers messaging and community features to facilitate bookings and local life. You must not use them to send spam, sexual content, hate speech, harassment, threats, doxxing, scams, phishing or any unlawful material. The Platform is not responsible for the behaviour of users in private messages, in person, in groups, at events or after a connection has been made through the Platform. Any in-person interaction is at your own risk.

15. Disclaimers

The Platform is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, availability, uninterrupted operation or non-infringement. We do not warrant the truthfulness, legality, safety, quality or completeness of any listing, host, provider, business or content.

16. Limitation of liability

To the maximum extent permitted by law, Corralejo Living, its owners, operators, employees and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, data, goodwill, opportunity, reputation, holidays or enjoyment, arising from or in connection with: (a) any listing, booking, stay, activity, lesson, service or local deal; (b) any act, omission, negligence, fraud, accident, injury or death of any user or third party; (c) any unavailability, error, bug or interruption of the Platform; (d) any unlawful, infringing, dangerous or fraudulent content; (e) any payment, refund or chargeback dispute between users.

Where liability cannot be excluded under applicable mandatory law, our aggregate liability towards any user for any and all claims arising in any 12-month period is strictly capped at the greater of (i) the total service fees collected by the Platform from that user during that period or (ii) one hundred euros (€100).

17. Indemnification

You agree to defend, indemnify and hold harmless Corralejo Living, its owners, operators, employees and contractors from and against any claim, liability, loss, damage, fine, tax, penalty, cost or expense (including reasonable legal fees) arising from or related to: (a) your use of the Platform; (b) any content you publish; (c) any listing, activity, service or transaction you offer or take part in; (d) your breach of these Terms or applicable law; (e) your tax, licensing, insurance, employment or immigration obligations; (f) any injury, accident or death involving you, your equipment, your premises or your customers.

18. Suspension and termination

We may suspend, restrict or terminate your account, listings or access to the Platform at any time, without prior notice and without refund, where we believe that you have violated these Terms, applicable law or community standards, or where required by a competent authority. You may close your account at any time by contacting hola@corralejoliving.com.

19. Intellectual property

The Platform, its software, design, brand, logo and original content are protected by intellectual-property laws and remain the property of Corralejo Living or its licensors. You retain ownership of the content you upload but grant the Platform a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, display, reproduce, adapt, translate, transmit and promote it for the purposes of operating, marketing and improving the Platform. This licence survives the deletion of a listing where strictly necessary to keep backups, comply with the law or defend our rights.

20. Notice-and-action (Digital Services Act)

If you believe that content on the Platform is illegal or violates these Terms, please send a notice to hola@corralejoliving.com including the URL, the reason, your contact details and a statement of good faith. We will assess the notice and act in accordance with Regulation (EU) 2022/2065. We may share necessary information with competent authorities upon a lawful request.

21. Data protection and GDPR

We process personal data in accordance with the GDPR (Regulation (EU) 2016/679) and the Spanish data-protection framework. Please read our Privacy Policy. By using the Platform you acknowledge that you have read and understood it. We log consent to these Terms and to the Privacy Policy (timestamp, version, locale, IP, user-agent) as proof of acceptance, in accordance with Article 7 GDPR.

22. Force majeure

We are not liable for any delay, interruption or failure to perform caused by events beyond our reasonable control, including natural disasters, storms, fires, floods, pandemics, epidemics, strikes, civil unrest, government action, cyber-attacks, internet outages, hosting failures or third-party-provider failures.

23. Modifications

We may amend these Terms at any time. Material changes will be notified by email, in-app banner or website notice at least 15 days before they take effect, except where a shorter notice is required by law or safety. Continued use of the Platform after the effective date constitutes acceptance. We keep version history and consent logs for evidentiary purposes.

24. Governing law and jurisdiction

These Terms are governed by the laws of Spain, without prejudice to mandatory consumer-protection laws of your country of residence within the European Union. Any dispute arising in connection with these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts of Las Palmas de Gran Canaria, Spain, except where mandatory law gives a consumer the right to sue in their country of residence. Consumers in the EU may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
